Introduction

Welcome to PenguinStudios. These Terms and Conditions ("Terms") govern your use of our website located at penguinstudios.eu and our services including custom development of Minecraft plugins, Discord bots, and websites.

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access our services.

Services

PenguinStudios provides the following services:

Custom Minecraft plugin development
Discord bot development and configuration
Website design and development
Server configuration and optimization
Technical consulting and support
Maintenance and update services

All services are provided on a project basis with specifications agreed upon before commencement of work.

Payment Terms

Custom Projects

For custom development services, we require:

50% upfront payment before starting the project
50% final payment after project review but before final delivery
All payments are non-refundable once work has commenced

Accepted Payment Methods

PayPal
Bank Transfer (SEPA/SWIFT)
Other methods upon request and agreement

Pricing

All prices are quoted in EUR (€) unless otherwise specified. Prices may vary depending on scope changes requested by the Client. In the case of a different currency, it is the Client's responsibility to ensure the correct equivalent amount is paid in EUR.

Project Timelines and Delays

Due to high demand and the fact that our team consists of only three developers, delivery times for private/custom work may be longer than initially estimated.

Delays may be communicated even after payment has been made. We will keep you informed as soon as reasonably possible if an extension to the timeline is required.

Estimated delivery dates are indicative and not guaranteed unless expressly stated otherwise in a written agreement.

Business Days and Time Zone

We operate exclusively on business days: Monday to Friday. All timelines, support availability, and communications are based on the Italian time zone (Europe/Rome), which observes CET/CEST.

Requests and communications sent on weekends will be handled on the next business day.

Intellectual Property Rights

Client Projects

Upon full payment, the client receives full ownership rights to the custom code developed specifically for their project, except for:

Pre-existing libraries and frameworks
Open-source components
Our proprietary tools and utilities
Generic code modules that may be reused in other projects

Portfolio Rights

We reserve the right to display completed projects in our portfolio and marketing materials unless specifically agreed otherwise in writing.

License Terms

Plugin and Bot Licenses

For pre-made plugins and bots available through our platform:

Licenses are bound to a single server/IP address
License transfers require prior approval
Redistribution of licensed software is strictly prohibited
Licenses are lifetime unless otherwise specified
We reserve the right to revoke licenses for Terms violations

IP Address Changes

Users may request to change the IP address associated with licensed products up to 3 times per month. Additional requests beyond this limit may either:

Be subject to administrative approval, or
Be granted upon payment of an additional fee, determined on a case-by-case basis by the Administration.

User Responsibilities

By using our services, you agree to:

Provide accurate and complete information
Maintain the confidentiality of your account credentials
Not use our services for illegal or unauthorized purposes
Not reverse engineer, decompile, or modify our software without permission
Not resell or redistribute our products without authorization
Comply with all applicable laws and regulations

Support and Maintenance

Support Scope

Basic support includes:

Bug fixes for issues in our original code
Basic configuration assistance
Documentation and usage guidance

Additional Support

Extended support, feature additions, and modifications are available as separate paid services. Support response times vary based on the service package selected.

Limitation of Liability

To the maximum extent permitted by law, PenguinStudios shall not be liable for:

Any indirect, incidental, special, or consequential damages
Loss of profits, data, or business opportunities
Damages resulting from unauthorized access or use of our services
Service interruptions or system failures

Our total liability shall not exceed the amount paid by you for the specific service in question.

Termination

We reserve the right to terminate or suspend access to our services immediately, without prior notice, for:

Breach of these Terms and Conditions
Fraudulent or illegal activities
Non-payment of services
Behavior that harms our reputation or other users

Upon termination, all licenses and access rights granted to you will be immediately revoked.

Privacy

Your use of our services is also governed by our Privacy Policy. We collect and process data in accordance with GDPR and applicable data protection laws. By using our services, you consent to such processing.

We use Discord OAuth for authentication and may store your Discord ID, username, and avatar for service provision purposes.

Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

First, good faith negotiations between the parties
If unresolved, through mediation
As a last resort, through the competent courts of Italy

These Terms are governed by the laws of Italy, without regard to its conflict of law provisions.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any modifications indicates acceptance of the updated Terms.

We recommend reviewing these Terms periodically for any changes.
